Establishments
Employers like STC could choose to combine all
their Ontario locations together to do pay equity; deal with the
locations separately; or combine a few and separate the rest.
The law
The Act states that the establishment is all the
employees of an employer who work in a geographic division:
- A geographic division can be a county, territorial district,
or regional municipality, as described in the Territorial Divisions
Act.
- An employer can decide to expand the definition of establishment
to include two or more geographic divisions. If the workplace
has a union, this must be negotiated with the bargaining agent.
- All employees of an employer in a given geographic division
must be included in one establishment.
STC's establishments
All of STC's locations were in different regional
municipalities. STC could have chosen to make each location into a single
establishment or combined some or all of them together.
STC made the following choices:
Establishment # 1: Toronto
(One location in the Greater Toronto Area - Head Office)
STC decided that Toronto Head Office should have its own establishment.
Establishment # 2: Belleville and Kingston
(One location in Belleville - Plant; and
two locations in Kingston - Plant and a 10-person office)
The Belleville and Kingston plants may be in separate geographic
divisions, but they share the same Human Resources director and
staff. STC felt it made sense to combine these two locations into
one establishment.
Establishment # 3: Sarnia
(One location in Sarnia - Plant)
Sarnia's plant is a unique high tech work environment and has enough
male job classes to serve as comparators for the female job classes
at that location. Therefore, Sarnia was deemed to be one establishment.
Where to go from here
STC had now separated their Ontario locations into three groups,
or establishments. This meant that each establishment (Toronto,
Kingston/Belleville and Sarnia) was now to
proceed on their own to provide pay equity for their employees. Their first decision
was to determine how many plans were required per establishment.
